B1. Acceptance of Terms

By accessing neokometreach.com, submitting a form, requesting a quote, or engaging our Services, you agree to be bound by these Terms of Service.

If you do not agree to these terms, please do not use our Website or Services.

B2. Description of Services

neoKomet Reach provides B2B lead generation and outbound marketing services to clients based in India, which may include but are not limited to:

• Prospect list building - using third-party data platforms to identify and compile business contact information.
• Cold email campaign management - including copywriting, sequencing, and sending on behalf of clients.
• Reporting and analytics - covering campaign performance, replies, and booked meetings.
• Appointment setting - coordinating and scheduling meetings between clients and prospective business contacts.

The exact scope of Services for each client is defined in a separate signed Scope of Work or Service Agreement, which takes precedence over this general description in the event of any conflict.

B3. Quotes and Pricing

• Quote validity - quotes provided via the Website or in correspondence are estimates and valid for 30 days unless otherwise stated.
• Final pricing - confirmed only upon signed agreement between neoKomet Reach and the Client.
• Payment terms - as specified in the individual Service Agreement; typically an advance payment is required before work begins.
• Taxes - all quoted prices are exclusive of applicable GST unless stated otherwise.
• No obligation - requesting a quote or submitting an enquiry does not create a binding obligation on either party until a Service Agreement is signed.

B4. Client Responsibilities

• Accurate information - Clients must provide accurate business information, target criteria, and any required approvals for campaigns run on their behalf.
• Lawful use - Clients must not instruct us to target audiences or send content that is fraudulent, deceptive, or violates applicable Indian law.
• Timely feedback - Clients are responsible for reviewing and approving campaign materials within agreed timeframes to avoid delays.

B5. Data Used in Campaigns

• Sourcing - contact data used in outbound campaigns is sourced from third-party B2B data platforms and publicly available business information.
• Accuracy - while we take reasonable steps to verify data quality, we do not guarantee 100% accuracy of third-party sourced contact information.
• No resale - data compiled for a specific Client engagement is used solely for that engagement and is not resold or shared with other clients.
• Opt-outs - any opt-out or do-not-contact request received during a campaign is honoured immediately and the contact is removed from future outreach.

B6. Intellectual Property

• Website content - all content on neokometreach.com, including text, graphics, and logos, is the property of neoKomet Reach and may not be copied or reproduced without permission.
• Client deliverables - contact lists, campaign copy, and reports created specifically for a Client become the property of that Client upon full payment, unless otherwise agreed in the Service Agreement.
• Our methodology - our internal processes, templates, and systems remain the intellectual property of neoKomet Reach and are not transferred to Clients.

B7. Limitation of Liability

• No guaranteed results - while we apply industry best practices, we do not guarantee specific numbers of replies, meetings, or conversions, as outcomes depend on factors outside our control.
• Third-party tools - we are not liable for outages, errors, or data inaccuracies originating from third-party platforms we use to deliver Services.
• Maximum liability - our total liability for any claim arising from the Services is limited to the fees paid by the Client for the specific engagement in question.
• Indirect damages - we are not liable for indirect, incidental, or consequential damages, including loss of profits or business opportunities.

B8. Termination

• Notice period - either party may terminate an ongoing engagement with 30 days' written notice, unless otherwise specified in the Service Agreement.
• Outstanding fees - any fees owed for work completed up to the termination date remain payable.
• Data on termination - upon termination, Client-owned data and deliverables will be provided to the Client within a reasonable timeframe.

B9. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

B10. Future International Clients

neoKomet Reach currently serves clients based in India only.

Should we begin offering Services to clients outside India - including the United States, United Kingdom, or other jurisdictions - this Privacy Policy and these Terms will be reviewed and updated to reflect applicable international data protection and consumer protection laws before any such Services commence.

B11. Changes to These Terms

We may update this Privacy Policy and these Terms of Service from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons.

The updated version will be posted on this page with a revised "Last Updated" date.

Continued use of our Website or Services after changes are posted constitutes acceptance of the revised terms.
